Waste Collection Finsbury Park Service Terms

These Terms and Conditions set out the basis on which waste collection services are provided to customers in and around Finsbury Park. By booking or using any service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

1.1 In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the individual, business, landlord, tenant, managing agent, organisation or other party who requests or receives waste collection services.

Service Provider means the company or operator supplying the waste collection and related services.

Services means any waste, rubbish or recycling collection, removal, clearance, loading, transport or disposal service supplied by the Service Provider to the Customer.

Booking means a confirmed request by the Customer for Services on a specific date, time, location and price agreed with the Service Provider.

Waste means all items, materials and refuse presented by the Customer for collection, including household waste, commercial waste, bulky items and recyclables, excluding any prohibited or hazardous materials as defined in these terms or under applicable law.

2. Scope of Services

2.1 The Services include the collection, loading, transport and disposal or recycling of waste from the address agreed with the Customer at the time of booking.

2.2 The Service Provider will use reasonable care and skill in delivering the Services and will seek to ensure that waste is handled, transported and treated in accordance with applicable waste regulations and industry practice.

2.3 The specific type, volume and nature of waste to be collected, along with any access requirements or special handling needs, must be clearly described by the Customer at the time of booking.

2.4 The Service Provider reserves the right to refuse to collect any waste that is not as described, is unsafe to handle, is prohibited by law, or exceeds the agreed volume or weight.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any online booking system made available by the Service Provider.

3.2 When placing a booking, the Customer must provide accurate and complete information, including:

a. Full name, contact details and billing details.

b. Collection address in the service area.

c. Description, quantity and type of waste.

d. Any access restrictions, parking limitations or time constraints.

3.3 A booking is only confirmed when the Service Provider has accepted it and communicated confirmation, which may include the date, time window and price. The Service Provider may decline a booking at its discretion.

3.4 The Customer is responsible for ensuring that someone authorised is present at the collection address at the agreed time, or that clear instructions and access are provided in advance.

4. Service Area and Access

4.1 The primary service area includes Finsbury Park and surrounding districts, subject to the operational coverage of the Service Provider at the time of booking.

4.2 The Customer must ensure that adequate, safe and lawful access is available for the Service Provider’s vehicles and staff, including any required parking permissions, permits or loading bays.

4.3 Any delays, additional costs or inability to complete the Services caused by inaccessible premises, incorrect address details or lack of parking arrangements may result in extra charges or cancellation fees as detailed in these terms.

5. Customer Obligations

5.1 The Customer confirms that they are either the owner of the premises or waste, or are authorised by the owner or occupier to arrange the Services.

5.2 The Customer must:

a. Present the waste in a safe, accessible location as agreed at the time of booking.

b. Separate waste in accordance with any instructions given by the Service Provider, particularly where items are to be recycled.

c. Not present any prohibited or hazardous materials unless expressly agreed in writing and permitted by law.

d. Ensure that any fragile, sharp or heavy items are identified to the Service Provider’s staff.

5.3 The Customer warrants that all waste presented is theirs to dispose of and that its removal will not contravene any law, lease, tenancy agreement or third-party rights.

6. Waste Types and Prohibited Items

6.1 The Service Provider can collect most general household and commercial waste, bulky items, garden waste and certain recyclables, subject to capacity and prior agreement.

6.2 The following items, among others, are generally prohibited unless specifically agreed and appropriately packaged and documented: asbestos, clinical or medical waste, chemicals, solvents, flammable or explosive materials, gas cylinders, certain electrical items requiring specialist treatment, and any substance classified as hazardous under UK law.

6.3 The Service Provider reserves the right to inspect waste before loading and to refuse any items it reasonably believes to be hazardous, illegal or beyond the agreed scope.

6.4 If prohibited or hazardous items are discovered after collection, the Customer may be liable for any additional handling, disposal and regulatory costs incurred, as well as any fines or penalties arising from misdescription of the waste.

7. Pricing and Quotations

7.1 Prices may be based on estimated volume, weight, type of waste, access conditions and distance travelled. Quotations are normally provided prior to booking and are subject to confirmation upon arrival.

7.2 All quotations are given in good faith based on the information supplied by the Customer. If on arrival the waste is significantly different in volume, type or access complexity from that described, the Service Provider may adjust the price or decline the job.

7.3 Any change to the scope of work requested by the Customer will be subject to a revised price agreed before additional work is carried out.

7.4 All prices are stated exclusive of VAT unless expressly stated otherwise. Any applicable VAT will be added to the final invoice in accordance with UK law.

8. Payments

8.1 Payment terms will be confirmed at the time of booking. For most residential and small business customers, payment is due in full on completion of the collection, or in advance where requested.

8.2 Payment may be made by cash, debit card, credit card, bank transfer or other methods accepted by the Service Provider.

8.3 For account customers or commercial contracts, invoices are due for payment within the period specified on the invoice. If no period is specified, payment is due within 14 days of the invoice date.

8.4 The Service Provider reserves the right to charge interest and reasonable recovery costs on overdue amounts, in accordance with applicable UK legislation for late payment.

8.5 Failure to pay may result in suspension of Services, additional charges and legal action for recovery of the debt.

9. Cancellations and Amendments

9.1 The Customer may cancel or amend a booking by giving reasonable notice to the Service Provider, subject to any specific cancellation terms communicated at the time of booking.

9.2 Where the Customer cancels with less than 24 hours notice before the scheduled collection time, the Service Provider may charge a cancellation fee to reflect administrative and operational costs.

9.3 If the Customer is not present at the agreed time, or access is not available, or the job cannot proceed due to circumstances within the Customer’s control, this may be treated as a late cancellation and a call-out or cancellation fee may apply.

9.4 The Service Provider may cancel or reschedule a booking due to vehicle breakdown, staff illness, severe weather, safety concerns or other circumstances beyond reasonable control. In such cases, the Service Provider will attempt to notify the Customer as soon as practicable and will offer an alternative time or, where appropriate, a refund of any amount paid for Services not provided.

10. Performance of Services

10.1 The Service Provider will endeavour to attend the Customer’s premises within the agreed time window but does not guarantee exact times. Time shall not be of the essence unless expressly agreed in writing.

10.2 If the Service Provider anticipates a material delay, it will take reasonable steps to inform the Customer and agree a revised time or alternative date.

10.3 The Customer acknowledges that traffic, parking, road closures, local restrictions and operational issues may affect timing and that the Service Provider shall not be liable for minor delays or consequential loss arising from such delays.

11. Liability and Limitations

11.1 The Service Provider will take reasonable care to avoid damage to property while carrying out the Services. However, the Customer is responsible for removing or protecting any fragile items, floor coverings, decorations or fittings that may be at risk.

11.2 The Service Provider shall not be liable for any damage arising from inherent defects or weakness in the property, fixtures or access routes, or from the handling of excessively heavy, awkward or poorly packed items where the Customer has requested their removal.

11.3 To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect or consequential loss, including loss of profit, business interruption or loss of opportunity.

11.4 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.

11.5 Except in relation to non-excludable liabilities, the total aggregate liability of the Service Provider to the Customer for any claim arising out of or in connection with the Services shall be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim.

12. Compliance with Waste Regulations

12.1 The Service Provider is committed to handling and disposing of waste in compliance with applicable UK waste legislation, including duty of care requirements and the need to use appropriately licensed facilities.

12.2 The Customer acknowledges their own duty of care in ensuring that waste is transferred only to a responsible, authorised carrier and that accurate information about the nature of the waste is provided.

12.3 Where required, the Service Provider will complete appropriate documentation such as waste transfer notes. The Customer shall cooperate by providing any necessary information and retaining copies of documentation where advised.

12.4 The Customer agrees not to request or permit any unlawful disposal of waste and understands that both parties may be subject to enforcement action if waste is illegally dumped or mismanaged.

13. Data Protection and Privacy

13.1 The Service Provider may collect and process personal information about the Customer in order to manage bookings, provide Services, issue invoices and comply with legal obligations.

13.2 The Service Provider will take appropriate steps to safeguard personal data and will not sell or disclose such information to third parties except where necessary to deliver the Services, comply with law or with the Customer’s consent.

13.3 The Customer has the right to request access to personal data held about them and to request correction of inaccurate information, in accordance with applicable data protection laws.

14. Complaints and Dispute Resolution

14.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Service Provider promptly, providing details of the issue and any supporting information.

14.2 The Service Provider will aim to investigate complaints fairly and respond within a reasonable timeframe, offering, where appropriate, corrective action, partial refund, re-performance of the Service or other remedy.

14.3 Both parties agree to attempt to resolve any dispute amicably in the first instance before considering legal proceedings.

15. Force Majeure

15.1 Neither party shall be liable for any failure or delay in performing obligations under these Terms and Conditions where such failure or delay results from events beyond reasonable control, including but not limited to extreme weather, natural disasters, war, terrorism, civil unrest, strikes, pandemics, utility failures or transport disruptions.

15.2 In such cases, the affected party shall notify the other as soon as reasonably practicable and will use reasonable endeavours to resume performance once the event has ceased.

16. Variation of Terms

16.1 The Service Provider may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that booking.

16.2 Where changes are material and ongoing, the Service Provider may notify regular or account customers and may require acceptance of the updated terms before further Services are provided.

17. Severability

17.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, such provision shall be severed from the remaining terms, which shall continue in full force and effect.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services.

By placing a booking for waste collection services in Finsbury Park, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
